AΩGO Terms of Use

These terms govern the AΩGO website, application, module packages, account and download services, subscriptions, and beta testing program.

1. Agreement to these terms

These Terms of Use are a contract between you and Alpha y Omega. By creating an account, downloading or installing AΩGO, buying or redeeming access, joining the beta program, or using the website, app, or a module, you agree to these terms and the AΩGO Privacy Policy.

If you do not agree, do not create an account or use AΩGO. If you use AΩGO for an organization, you state that you have authority to accept these terms for that organization.

2. Eligibility and accounts

You must be at least 18 years old or the age of legal majority where you live to create an account on your own. A younger person may use AΩGO only with permission and supervision from a parent or legal guardian. AΩGO is not directed to children under 13.

Provide accurate account and contact information and keep it current. You are responsible for activity under your account, keeping your password private, and promptly telling us about suspected unauthorized access. Do not share a personal access code or account with another person unless Alpha y Omega has expressly authorized it.

We may require email confirmation, an access code, subscription validation, or device authorization before some features or downloads become available.

3. What AΩGO provides

AΩGO provides guided audio experiences that may combine pre-generated narration, synchronized words, related imagery, optional stereo binaural audio, user-selected playback settings, and app or module downloads. Modules may address sleep, learning, fitness, weight, performance, self-help, perception, education, or entertainment.

Available features, voices, modules, images, audio, schedules, supported devices, and beta functions may differ by version, platform, account, subscription, or testing assignment. Some content must be downloaded before it can play.

4. Health, wellness, and listening safety

AΩGO is not medical care

AΩGO is a wellness, education, fitness, performance, self-help, and entertainment product. It is not a medical device or a health-care, mental health, or emergency service. It does not provide a diagnosis, medical treatment, psychotherapy, or professional advice, and it does not create a doctor-patient or therapist-client relationship.

Do not use AΩGO in place of qualified care or delay seeking care because of something in the app. Ask a qualified professional before beginning a fitness, weight, sleep, or wellness program if you have a medical condition, take medication, are pregnant, have concerns about exercise or sleep, or are unsure whether a module is appropriate for you.

If you may harm yourself or someone else, or have a medical or mental health emergency, call emergency services. In the United States, call 911 for an emergency or call or text 988 for the Suicide & Crisis Lifeline. Use the appropriate emergency or crisis service where you live.

Use stereo headphones for binaural audio

The intended binaural presentation requires stereo earbuds or headphones because each ear must receive a different audio channel. Narration and other content may still work without them, but the binaural effect may be weak or absent. Use a comfortable volume. Stop if you feel pain, dizziness, distress, disorientation, or other discomfort.

Use sessions only in a safe setting

Never use Sleep mode, a sleep routine, or any session that reduces alertness while driving, operating machinery, supervising a hazardous activity, or doing anything that requires attention. Before beginning a sleep session, be in a safe place where you are prepared to sleep. If a session becomes distracting or uncomfortable, pause or stop it.

5. License, downloads, and installations

While your access is active, Alpha y Omega gives you a limited, personal, non-exclusive, non-transferable, and revocable license to install and use AΩGO and authorized modules for their intended purpose. You do not own the application, module package, narration, artwork, audio, or other supplied content.

Your plan or assigned access controls how many installations may be active. Standard access may be limited to one active installation. Administrative or testing access may allow more devices. A transfer may deactivate a prior installation. You may not bypass installation limits, access controls, package signatures, subscription checks, or download protections.

You are responsible for using a compatible device, maintaining Internet access when validation or download is required, installing available security or compatibility updates, and following the installation instructions. Data charges and device costs are your responsibility.

Updates may add, change, repair, or remove features. We may require a current version when an older version is insecure, incompatible, or no longer supported.

6. Subscriptions, fees, renewal, and refunds

Prices, taxes, subscription length, included products, installation allowance, and payment terms will be shown before purchase. The AΩGO application and add-on modules may have separate subscription periods. The expiration of one product does not automatically pause or extend another product.

A subscription renews only if the checkout page clearly states that it will renew and you affirmatively choose that option. Otherwise, access ends at the close of the purchased term unless you buy another term. If automatic renewal is offered, the checkout disclosures and cancellation instructions become part of these terms.

Charges are due when shown at checkout. Any refund terms shown at purchase become part of these terms. When no separate refund policy is shown, refunds are handled as required by law and otherwise may be approved by Alpha y Omega based on the circumstances. We may correct pricing or product-description errors before fulfilling an order and will provide a refund if we cancel a paid order.

Beta access granted in exchange for testing and feedback is not a paid customer subscription and does not create ownership or a right to continued free access.

7. Beta testing program

Beta software and module packages are pre-release products. They may contain errors, incomplete features, performance problems, or changes that affect settings or stored data. Do not rely on beta software for medical care, emergencies, safety-critical activity, or irreplaceable information.

A beta tester may receive the application and assigned modules without charge while completing the required questionnaires and constructive feedback within the stated testing period. Unless an assignment states otherwise, the applicable deadline begins on registration, assignment, or download as described in the tester's account. Access to a late assignment may be paused or removed. An authorized AΩGO administrator may extend a deadline, restore access, or grant an exception.

Submit honest results and enough detail to help reproduce an issue. Do not upload another person's private information without permission. Optional screenshots, recordings, and other evidence should be limited to what is needed for the test. Beta feedback is governed by the license in Section 10 and the Privacy Policy.

Alpha y Omega may change assignments, testing periods, builds, modules, access, or the beta program at any time. We may remove a tester who does not complete assigned work, misuses the program, shares protected files or codes, or creates a security or safety risk.

8. Acceptable use

You may not:

  • Use AΩGO in violation of law or another person's rights.
  • Share, sell, rent, sublicense, or publicly distribute the app, modules, access codes, beta files, or account credentials.
  • Copy, modify, translate, reverse engineer, decompile, bypass, or extract protected software or content except to the limited extent a law does not allow that restriction.
  • Interfere with the service, test for vulnerabilities without written permission, introduce malicious code, overload systems, or attempt unauthorized access.
  • Impersonate another person, provide false information, misuse another person's account, or use automated methods to create accounts or retrieve files.
  • Remove ownership notices or use AΩGO content to build or train a competing product without written permission.

9. Third-party services and links

AΩGO relies on third-party services for hosting, authentication, storage, downloads, email, and, when available, payment processing. Those services may have their own terms. We are not responsible for a third-party website or service that we do not control. A link does not mean Alpha y Omega endorses everything on the linked site.

10. Ownership, content, and feedback

Alpha y Omega and its licensors own AΩGO, including its software, design, compilation, original narration, recordings, images, logos, module arrangements, and other original materials. Some source works or factual material may be in the public domain or owned by others. Those rights remain with their respective owners.

You keep ownership of original feedback or evidence you submit. You give Alpha y Omega a worldwide, royalty-free license to host, copy, review, adapt, summarize, and use that material as reasonably needed to run the beta program, provide support, investigate issues, improve AΩGO, document testing, and meet legal obligations. This license is non-exclusive and lasts only as long as reasonably needed for those purposes, except that de-identified findings and incorporated product improvements may be retained.

If you send a suggestion, you understand that we may already be working on a similar idea and may use your suggestion without payment or an obligation to make the change.

11. Availability and changes

We work to keep AΩGO available, but we do not promise uninterrupted or error-free operation. Access may be interrupted for maintenance, updates, security, provider outages, Internet problems, device incompatibility, expired subscriptions, beta deadlines, or events outside our reasonable control.

We may change, suspend, or discontinue a feature, voice, module, platform, or service. If we discontinue a paid product during its active term, we will provide the remedy required by law and may offer a replacement, credit, or prorated refund when appropriate.

12. Disclaimers

To the extent permitted by law, AΩGO is provided "as is" and "as available." Alpha y Omega disclaims implied warranties of merchantability, fitness for a particular purpose, quiet enjoyment, non-infringement, and warranties arising from a course of dealing. We do not warrant a particular health, sleep, learning, fitness, weight, performance, emotional, or other result.

Some jurisdictions do not allow certain warranty disclaimers. In those places, these disclaimers apply only to the extent allowed, and you keep any non-waivable consumer rights.

13. Limitation of liability

To the extent permitted by law, Alpha y Omega and its owners, employees, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, business interruption, or the cost of a replacement service arising from AΩGO.

To the extent permitted by law, the total liability of Alpha y Omega for all claims relating to AΩGO will not exceed the greater of the amount you paid Alpha y Omega for the affected product during the 12 months before the event giving rise to the claim or $100.

These limits do not apply to liability that cannot legally be limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law does not permit a limit.

14. Your responsibility for misuse

To the extent permitted by law, you agree to reimburse Alpha y Omega for reasonable losses, liabilities, and expenses, including legal fees, caused by your unlawful use of AΩGO, your violation of these terms, or your infringement of another person's rights. This does not require you to reimburse us for harm caused by Alpha y Omega's own wrongdoing.

15. Suspension and termination

You may stop using AΩGO at any time. You may request account deletion as described in the Privacy Policy, subject to records we are allowed or required to retain.

We may suspend or terminate access if a subscription or beta assignment expires, payment fails, an account violates these terms, continued use creates a security or safety risk, or the law requires it. When practical, we will give notice and a chance to correct the issue. Sections that by their nature should continue after termination, including ownership, disclaimers, liability limits, governing law, and accrued payment obligations, will continue.

16. Governing law and disputes

These terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Any court proceeding that is not required by law to be brought elsewhere must be filed in a state or federal court located in Maricopa County, Arizona, and each party consents to that court's jurisdiction.

Before filing a claim, please send a written description to the contact below and allow 30 days for an informal effort to resolve it. This informal process does not stop either party from seeking urgent court relief and does not reduce any right or deadline that applicable law does not allow us to change.

17. General terms

If a court finds part of these terms unenforceable, the rest will remain in effect and the invalid part will be enforced to the maximum extent permitted. A delay in enforcing a term is not a waiver. You may not transfer these terms or your account without our written permission. We may transfer these terms as part of a reorganization, financing, merger, or sale of the business or product.

These terms, the Privacy Policy, the terms shown at purchase, and any written beta assignment rules are the entire agreement about AΩGO. If they conflict, specific purchase terms control payment for that purchase, specific beta rules control that assignment, and these Terms of Use control everything else.

18. Changes to these terms

We may update these terms as AΩGO changes. We will post the revised terms here and update the date at the top. If a change materially affects current paid access, we will provide additional notice when required. Continued use after the new effective date means you accept the updated terms. If you do not agree, stop using the service.
